1. Acceptance of Terms
By accessing or using the website privatedevops.com and the services provided by Private DevOps LTD (“PrivateDevOps”, “we”, “us”, or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use our website or services.
2. Services Offered
PrivateDevOps provides DevOps consulting, infrastructure management, Kubernetes management, cloud infrastructure, security and compliance, and related technical services. The specific scope, deliverables, and timelines for each engagement will be defined in a separate service agreement or statement of work.
2.1. Free Interactive Tools
Our website offers free interactive tools including website speed tests, cost calculators, infrastructure assessments, SSL certificate tools, email deliverability checks, and DNS lookup utilities. These tools are provided free of charge for informational and educational purposes only.
- No warranty: Free tools are provided “as is” without any warranty of accuracy, completeness, or fitness for a particular purpose. Results are estimates and should not be relied upon as professional advice.
- Availability: We do not guarantee uninterrupted availability of free tools and may modify, suspend, or discontinue any tool at any time without notice.
- Use restrictions: You may not use automated scripts, bots, or scraping tools to access or query our free tools. Usage is subject to rate limiting (10 requests per minute per IP address). Commercial redistribution of tool results is prohibited without written consent.
- Data handling: Data you submit to our free tools (such as domain names or configuration parameters) is processed in real time and is not stored beyond the duration of the request, except when you explicitly create a share link (see Section 2.2).
2.2. Shared Results
Some free tools allow you to share results via a temporary link. When you click “Copy Link”, the tool results are stored on our servers for 7 days, after which they are automatically and permanently deleted. Shared links are accessible to anyone who has the URL. You are responsible for controlling who you share these links with. We do not monitor or moderate shared content.
3. Payment Terms
Payment terms are governed by the individual service agreement between PrivateDevOps and the client. Unless otherwise agreed in writing, the following standard invoice schedule applies:
- 14 days before due date: Invoice is issued and sent to the client.
- 7 days before due date: A reminder notification is sent.
- Due date: Payment is expected on or before this date.
- 1 day overdue: A first overdue reminder is sent.
- 3 days overdue: A second overdue reminder is sent.
- 5 days overdue: A third overdue reminder is sent, along with a warning that the service may be suspended.
- 10 days overdue: The invoice is considered delinquent. Services may be automatically suspended or cancelled until payment is received.
All fees are exclusive of applicable taxes unless otherwise stated. Late payments may be subject to interest charges as permitted by applicable law.
4. Use of Website
You agree to use our website only for lawful purposes and in a manner that does not:
- Infringe the rights of others or restrict or inhibit their use of the website.
- Attempt to gain unauthorised access to our systems, networks, or data.
- Introduce malicious software such as viruses, trojans, worms, or other harmful code.
- Engage in any activity that could damage, disable, or impair the functioning of our website.
- Use the website to transmit unsolicited advertising or spam.
- Use automated tools, bots, or scripts to scrape, crawl, or access our free tools or API endpoints beyond normal individual use.
- Circumvent or attempt to circumvent rate limiting or other access controls.
5. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, software, and documentation, is the property of Private DevOps LTD or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.
Any tools, scripts, or deliverables created as part of our services remain the intellectual property of PrivateDevOps unless otherwise agreed in writing in a service agreement.
6. Disclaimer of Warranties
Our website and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, PrivateDevOps disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific results from the use of our services.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Private DevOps LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, including but not limited to loss of profits, data, business opportunities, or goodwill.
Our total aggregate liability for any claim arising out of or in connection with these Terms or our services shall not exceed the total amount paid by you to PrivateDevOps in the twelve (12) months preceding the event giving rise to the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Private DevOps LTD, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms.
- Your misuse of our website or services.
- Your violation of any applicable law or regulation.
- Any third-party claims resulting from your use of our services.
9. Termination
We reserve the right to suspend or terminate your access to our website and services at any time, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is detrimental to our business interests.
Upon termination, all provisions of these Terms which by their nature should survive shall remain in full force and effect, including but not limited to intellectual property, limitation of liability, indemnification, and governing law provisions.
10. Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to natural disasters, acts of war or terrorism, pandemics, government actions, power failures, internet or telecommunications failures, or cyberattacks.
11. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sofia, Bulgaria.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, services, or applicable laws. Changes will be posted on this page with an updated revision date. Your continued use of our website or services after any changes constitutes acceptance of the revised Terms.
